1. Pricing and Availability

Prices displayed on our website apply both to in-store and Click-and-Collect purchases. Stock levels displayed on our website are based on our stock-on-hand records, and are updated at regular intervals throughout the working day.  We endeavour to keep the displayed prices and stock levels accurate at all times, but occasional discrepancies may arise.

All purchases made through kingsdiy.com are for Click-and-Collect from our premises at 45 Yorktown Road, Sandhurst GU47 9DU.

2. Cookies, Payments and Personal Information

Our website uses cookies for essential functionality only.  Use of our Click-and-Collect basket constitutes acceptance of cookies for this functionality.  These cookies do not store any personally-identifiable information.

Our website will only collect or store personally-identifiable information as part of the Click-and-Collect order finalisation process, and this information will not be used for any purpose except the fulfilment of your order.

Payments for our Click-and-Collect service are securely handled on our behalf by PaymentSense.  No part of your credit/debit card information is collected or stored by our own website.

3. Our Contract With You

Payment must be received in full for the stated price of the goods before your order can be accepted.  Once your payment has been authorised, your order will be accepted and this brings into existence a legally binding contract between us.  You will receive an acknowledgement email from us using the address which you have provided; this will include your collection reference.

It is your responsibility to ensure that the contact details you provide during order finalisation are accurate.  If the provided email address and/or telephone number are incorrect and we are consequently unable to contact you with regard to your order, then we reserve the right to cancel the order and to refund any sum received in payment for it, and we shall not accept any further liability in the matter.

Upon acceptance of your Click-and-Collect order, we will pick your items and set them aside for collection at the earliest opportunity.  If we find we are unable to fulfil the order for any reason, we will notify you and take all reasonable steps to resolve the situation.

The contract between us shall be deemed fulfilled when you have collected the goods, except in the event that the provided goods are found to be incorrect or defective.  A receipt will be provided upon collection.

4. Our Right to Alter, Refuse or Cancel Click-and-Collect Orders

We reserve the right to refuse or cancel any order, for reasons including but not limited to:

  • If we have insufficient stock to fulfil the order.
  • If one or more of the items ordered has been incorrectly described or priced on our website.
  • If you are attempting to purchase age restricted products and we are not satisfied that you are old enough to do so.
  • If the card payment is unauthorised.

Where possible, instead of cancelling an order, we may offer you an equivalent product at the same price.

In the event that we refuse or cancel your order, we will notify you by email using the address you have provided, and we will reimburse any sum paid by you in relation to the order.

5. Your Right to Cancel Click-and-Collect Orders

Should you choose to cancel your order before the goods have been collected, you must notify us by telephone on 01252 872219 or by emailing us at sandhurst@kingsdiy.com from the same address which you provided when placing the order.  Your name and collection reference will be required.  Once this notification has been received, we will cancel the order and reimburse any sum paid by you in relation to it.

If you wish to return some or all of your items after they have been collected, then this will follow the same returns process as if the item(s) had been purchased in-store: you must bring the item(s) in question back to our premises along with their packaging and your receipt.

If you wish to return items from a Click-and-Collect purchase for any reason other than a defect, then they must be returned in the same condition that they were in when collected.  Certain items, including but not limited to paints and locks, cannot be refunded once opened, unless they are defective.

6. Recourse in the Event of Missing, Incorrect or Defective Goods

When picking items to fulfil a Click-and-Collect order, we will make every effort to ensure that the provided items are as described and are in good order.  In the event that they are not as described or are not in good order, then we shall take all reasonable steps to remedy the error.

It shall be the customer's responsibility to check the goods upon collection to ensure that all of the ordered items are present.  If our staff have missed any item(s) from the order then the shortfall must be notified immediately, and if we have the stock available to do so we will fulfil the shortfall immediately, otherwise we will reimburse the cost of the missing item(s).  We cannot accept subsequent claims for missing items once the customer has taken their goods and left our premises.

In the event that the wrong items are supplied, they may be returned to us and exchanged for the correct items without any further charge, provided the correct stock is available.  If the correct items are no longer available then we will seek to offer comparable alternatives; otherwise, we will refund the cost of the incorrect items.

If any of the items from a Click-and-Collect purchase are found to be defective, then they shall be subject to the same returns policy as in-store purchases.  The items must be returned to our premises along with your receipt.  We will endeavour to replace like-for-like wherever possible, and if this proves not to be possible then we will endeavour to provide an equivalent product; if no other option is feasible then we will refund the defective items.

We will not be obliged to offer any additional compensation for disappointment suffered, nor will we be liable to you for any losses (whether direct, indirect or consequential) or damage or inconvenience arising out of any problem with goods or their delivery and we shall have no liability to pay any money by way of compensation other than refunding the cost of goods.

7. Unforeseen Circumstances

While we make every reasonable effort to fulfil our customers' requirements, we may at times be compelled to alter or cancel orders based on events or circumstances beyond our control, including but not limited to wars, terrorist activity, strikes and other industrial disputes, breakdown of physical or digital infrastructures, or natural disasters such as fires, floods, and storms.  We shall have no liability for any failure caused by such events or circumstances.

8. Governance, Validity and Entire Agreement

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

These Terms and Conditions, together with our current website prices, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us.  By placing an order though this website you agree to accept these Terms and Conditions and our Privacy Policy.

Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods for sale by us.  Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Images appearing on our website are illustrative only, and may not exactly match the appearance of the actual product.  Product dimensions, where provided, are approximate.

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected to the extent that they are capable of continuing in force without the unenforceable term or condition.

9. Disclaimer

Neither King & Sons (Sandhurst) Ltd, nor any of its directors, partners, employees or other representatives, shall be liable for any loss or damage arising out of or in connection with the use of this website.  This limitation is comprehensive and applies to all damages of any kind, including but not limited to direct, indirect, consequential or compensatory damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

King & Sons (Sandhurst) Ltd accepts no liability for any information or content contained in external third-party websites which link to or from this website.

Notwithstanding the foregoing, these Terms and Conditions are not intended to curtail your statutory rights in any way.
